1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the website located at allaroundconstructionx.com and your engagement of construction, remodeling, and repair services from All Around ConstructionX, a residential contracting business operated by Darrick Boyd and based in Trenton, Ohio, within Butler County. By requesting a free in-home consultation, submitting a Free Quote form, signing a written contract, or otherwise engaging our crews for any of the fifteen services listed on our Services page — including kitchen remodeling, bathroom remodeling, home renovations, room additions, basement finishing, interior painting, exterior painting, flooring installation, tile installation, drywall installation and repair, roofing, siding installation and repair, window and door installation, deck and patio construction, and fence installation — you agree to be bound by these Terms.

If you do not agree with any portion of these Terms, you should not submit a quote request, sign a proposal, or otherwise retain All Around ConstructionX for services. These Terms apply to all clients located throughout our service area, including Cincinnati, Dayton, Hamilton, Middletown, Fairfield, West Chester, Mason, Lebanon, Monroe, Springboro, Franklin, Oxford, Sharonville, Blue Ash, Loveland, Wyoming, Reading, Glendale, Miamisburg, and Kettering, as well as any Tri-State jobs extending into Indiana or Kentucky border communities.

2. Company Information & Service Area

All Around ConstructionX is based at Trenton, Ohio, and provides residential construction and remodeling services throughout the Tri-State Area — a region spanning southwest Ohio, southeast Indiana, and northern Kentucky. Our primary Ohio service footprint includes Butler, Montgomery, and Warren County communities such as Hamilton, Middletown, Fairfield, West Chester, Mason, Lebanon, Monroe, Springboro, Franklin, Oxford, Sharonville, Blue Ash, Loveland, Wyoming, Reading, Glendale, Miamisburg, Kettering, Cincinnati, and Dayton.

Because Ohio does not maintain a single statewide general contractor license, work performed under these Terms is governed by whichever local registration or permitting authority applies to the property's jurisdiction. For projects sited within Trenton or unincorporated Butler County, this may include Butler County Building Department registration; for projects in other municipalities within our service area, local city or township building department rules control. Clients are encouraged to confirm applicable local registration requirements with All Around ConstructionX prior to contract signing.

All correspondence, contract disputes, and formal notices under these Terms should reference All Around ConstructionX at its Trenton, Ohio business address, and should be directed through the contact channels listed in Section 19 below.

3. Licensing, Registration & Subcontractor Credentials

While Ohio does not require a general residential contractor to hold a statewide license for most of the trades listed in Section 4, certain specialty scopes require licensure through the Ohio Construction Industry Licensing Board (OCILB). Specifically, any electrical, HVAC, hydronic, or refrigeration work performed in connection with kitchen remodeling, bathroom remodeling, room additions, or basement finishing projects will be performed either by appropriately OCILB-licensed subcontractors engaged by All Around ConstructionX, or disclosed to the client in writing prior to commencement if a separately licensed trade contractor is required.

All Around ConstructionX represents that it and its regularly engaged subcontractors maintain applicable municipal or county registration where required by the jurisdiction in which the project is located, and general liability insurance covering the scope of work performed. Clients may request proof of current registration, licensure, and insurance certificates for any project prior to signing a contract or authorizing a deposit.

Nothing in these Terms should be interpreted as a representation that a statewide Ohio general contractor license exists or is required for the trades performed by All Around ConstructionX; licensure obligations are scope- and jurisdiction-specific and are evaluated on a per-project basis.

4. Scope of Services

All Around ConstructionX provides the following residential services within the Tri-State Area: kitchen remodeling, bathroom remodeling, home renovations, room additions, basement finishing, interior painting, exterior painting, flooring installation, tile installation, drywall installation and repair, roofing, siding installation and repair, window and door installation, deck and patio construction, and fence installation. The specific scope, materials, and labor for any individual project are defined exclusively in the written contract executed between All Around ConstructionX and the client, not in general marketing materials, website copy, or verbal estimates provided during a free in-home consultation.

Any service not explicitly listed in the signed contract is considered outside scope and subject to a separate change order under Section 8. Preliminary estimates provided during a free in-home consultation are non-binding until formalized into a written, signed contract meeting the requirements of Section 5.

5. Written Contract Requirements

For any home construction service agreement exceeding $5,000, Ohio's Home Construction Service Suppliers Act (Ohio Revised Code Chapter 4722) requires specific contract language, and All Around ConstructionX complies by including in every qualifying written contract: (a) the full scope of work; (b) estimated start and substantial-completion dates; (c) an itemized breakdown of material and labor costs; (d) the change-order procedure described in Section 8; (e) responsibility for securing permits as described in Section 9; (f) applicable registration information for the contracting entity; and (g) a description of the dispute resolution process outlined in Section 16, which must generally be pursued before formal litigation is filed.

For contracts under $5,000, All Around ConstructionX still provides a written proposal covering scope, pricing, and timeline, but abbreviated disclosure requirements under ORC 4722 may apply. Clients should review their specific contract for the disclosures applicable to their project value and trade classification.

6. Home Solicitation Sales & Right of Cancellation

Many of our projects — particularly roofing, siding installation and repair, and exterior painting — originate from an in-home visit following storm damage, a door-to-door inspection offer, or a scheduled free in-home consultation at the client's residence. These transactions are classified as "home solicitation sales" under the Ohio Home Solicitation Sales Act (ORC 1345.21–1345.28) whenever the contract is signed at a location other than our regular place of business and the price exceeds $25.

For any home solicitation sale, All Around ConstructionX will provide: a written contract stating the total price, a description of goods and services, and the estimated completion timeline; and a completed "Notice of Cancellation" form giving the client the right to cancel the transaction within three (3) business days of signing, without penalty or obligation. To cancel under this right, the client must provide written notice to All Around ConstructionX at the Trenton, Ohio business address or by email to [email protected] before midnight of the third business day following contract execution.

This three-day cancellation right does not apply to emergency repairs specifically requested by the client to prevent imminent damage to person or property, where the client has furnished a separate written waiver of the cancellation period as permitted under Ohio law.

7. Payment Terms, Deposits & Progress Billing

Consistent with Ohio consumer protection guidance applicable to home solicitation sales, initial deposits collected by All Around ConstructionX generally do not exceed one-third (1/3) of the total contract value. Remaining payments are structured as progress payments tied to defined project milestones — for example, completion of framing on a room addition, hanging and taping of drywall, setting of tile in a bathroom remodel, or a final punch-list walkthrough — as specified in the written contract.

Final payment is due upon substantial completion and client walkthrough, unless otherwise negotiated in writing. Late payments may accrue interest as disclosed in the individual contract and may affect warranty activation dates described in Section 11. All Around ConstructionX does not accept payment structures that violate the deposit limitations of the Ohio Consumer Sales Practices Act (ORC 1345) for solicited home sales.

8. Change Orders

Any modification to the original scope of work — additional square footage on a basement finishing project, upgraded tile selections, relocated plumbing lines during a kitchen remodel, or added fence panels beyond the original linear footage — must be documented in a signed written change order specifying the additional cost, revised timeline, and any permit implications before the work is performed. Verbal change requests made on-site to a crew lead are not binding until reduced to a signed change order and countersigned by both parties.

Change orders affecting structural scope (room additions, roofing) may require an amended permit application with the relevant municipal building department, which can extend the project timeline; clients will be notified of any such delay in writing.

9. Permits, Zoning & Municipal Compliance

Permit responsibility is assigned explicitly in each written contract per the disclosure requirements of ORC 4722. In most cases, All Around ConstructionX pulls and manages permits for structural work — room additions, deck and patio construction, roofing replacements, and window and door installation involving header changes — through the applicable municipal or county building department covering the project address, whether that is the Butler County Building Department, the City of Hamilton, the City of Middletown, or another jurisdiction within our Tri-State service area.

Zoning setback requirements, particularly for room additions, deck and patio construction, and fence installation, vary by municipality; for example, rear-yard fence height limits and side-setback rules differ between Butler County unincorporated parcels and incorporated cities such as Fairfield or West Chester Township. Clients are responsible for disclosing any known HOA restrictions, easements, or prior zoning variances affecting the project property prior to contract signing. All Around ConstructionX is not responsible for delays caused by municipal permit review backlogs or HOA architectural review board timelines beyond our control.

Ohio's freeze-thaw climate cycle affects permitted work windows for exterior projects — concrete footings for decks, patios, and room addition foundations generally require placement below the local frost depth line, and many Butler and Montgomery County jurisdictions will not finalize footing inspections during hard-freeze conditions common from late December through February. Project schedules for exterior work are adjusted accordingly and disclosed in the applicable contract.

10. Mechanic's Liens & Notice of Furnishing

Ohio's mechanic's lien statute (ORC 1311.011–1311.99) allows contractors, subcontractors, and material suppliers to file a lien against the improved property to secure payment for labor and materials furnished. For residential projects, including room additions, deck and patio construction, and roofing jobs where All Around ConstructionX engages subcontracted crews for framing, electrical, or specialty installation, a lien must generally be filed within sixty (60) days of the last date labor or materials were furnished for residential property, or seventy-five (75) days for non-residential property.

Subcontractors or suppliers without direct contractual privity with the property owner are required under Ohio law to serve a "Notice of Furnishing" in order to preserve lien rights. Clients will be provided a list of any subcontractors or major suppliers engaged on projects exceeding standard scope so that appropriate notices can be tracked, and clients should retain copies of all progress payment receipts to help establish a clear payment record in the event of a lien dispute.

All Around ConstructionX will provide lien waivers upon receipt of final payment for any project where subcontracted labor or third-party materials were furnished, consistent with standard Ohio residential construction practice.

11. Warranties & Workmanship

All Around ConstructionX distinguishes between manufacturer warranties and workmanship warranties in every contract. Manufacturer warranties — covering products such as architectural shingles, vinyl or fiber-cement siding, replacement windows and doors, and engineered flooring — are passed through to the client per the manufacturer's published terms and are administered directly between the client and the manufacturer, with All Around ConstructionX assisting with documentation upon request.

Workmanship warranties provided directly by All Around ConstructionX vary by trade: cosmetic and lighter-duty trades such as interior painting, exterior painting, and drywall installation and repair carry a one- to two-year workmanship warranty against peeling, cracking, or improper adhesion under normal conditions; structural and building-envelope trades such as roofing, room additions, siding installation and repair, and deck and patio construction carry workmanship warranties ranging from five to ten years depending on the specific scope and materials used, as stated in the individual contract.

For new residential construction components (such as a full room addition), Ohio recognizes an implied warranty of habitability, which operates independently of and in addition to any express workmanship warranty stated in the contract. Nothing in these Terms is intended to waive or limit that implied warranty as applied under Ohio common law.

12. Weather, Delays & Force Majeure

Southwest Ohio's climate directly affects scheduling for exterior trades. Roofing, siding installation and repair, exterior painting, and deck and patio construction are weather-dependent and may be rescheduled due to precipitation, high humidity affecting paint or stain cure times, or sustained temperatures below manufacturer-specified application thresholds — a common occurrence during Ohio winters and early spring stretches. Freeze-thaw cycles typical of a Butler County winter can also delay concrete curing for footings and patio slabs.

All Around ConstructionX is not liable for delays caused by weather, material supply chain disruptions, permit processing timelines controlled by third-party municipal offices, or other events beyond our reasonable control (force majeure). Revised timelines caused by such delays will be communicated to the client in writing as soon as reasonably practicable.

13. Limitation of Liability

To the fullest extent permitted under Ohio law, All Around ConstructionX's aggregate liability for any claim arising from services performed under these Terms is limited to the total contract price paid for the specific project giving rise to the claim. All Around ConstructionX is not liable for indirect, incidental, or consequential damages, including loss of use of the property during construction, except where such limitation is prohibited by the Ohio Consumer Sales Practices Act or other applicable Ohio consumer protection statute.

Nothing in this section limits any statutory remedy available to a consumer under ORC 1345 for unfair, deceptive, or unconscionable acts or practices in connection with a consumer transaction.

14. Website Use & Intellectual Property

All content on allaroundconstructionx.com, including text, photographs of completed projects throughout our service area, logos, and design elements, is the property of All Around ConstructionX and may not be reproduced, distributed, or used for commercial purposes without prior written consent. The Free Quote form, gallery images, and blog content are provided for informational purposes and do not constitute a binding offer of services until a formal written contract is executed.

You agree not to use automated tools to scrape, copy, or republish content from this website, and not to submit false or fraudulent information through the Free Quote or Contact forms.

15. Data Use & Privacy Reference

Information submitted through our Free Quote form, Contact page, or by phone or email is used solely to schedule free in-home consultations, prepare estimates, and communicate about active or prospective projects across our Tri-State service area. We do not sell client contact information to third parties. Full details regarding data collection, storage, and use are set out in our separate Privacy Policy, available upon request or linked from our website footer.

16. Dispute Resolution & Governing Law

These Terms and any contract executed between All Around ConstructionX and a client are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, regardless of whether the project is located in an Ohio, Indiana, or Kentucky community within our Tri-State service area.

In the event of a dispute concerning scope, payment, or workmanship, the parties agree to first attempt good-faith mediation, and if unresolved, binding arbitration, with venue in Butler County, Ohio, prior to filing any civil litigation, consistent with the dispute resolution disclosure required under Ohio's Home Construction Service Suppliers Act (ORC 4722). Clients whose disputes remain unresolved after mediation or arbitration may also file a complaint with the Ohio Attorney General's Consumer Protection Section, which maintains jurisdiction over unresolved consumer complaints involving Ohio-based contractors.

17. Termination

Either party may terminate a signed contract for material breach upon written notice and a reasonable opportunity to cure, as specified in the individual project contract. Upon termination, the client is responsible for payment for all labor performed and materials ordered or installed up to the termination date, and All Around ConstructionX will provide a final accounting and any applicable lien waivers within a reasonable time following final payment.

18. Severability & Entire Agreement

If any provision of these Terms is found unenforceable under Ohio law, the remaining provisions remain in full force and effect. These Terms, together with the individually signed project contract, constitute the entire agreement between All Around ConstructionX and the client with respect to the services described, superseding any prior verbal representations made during a free in-home consultation or marketing communication.

All Around ConstructionX may update these Terms from time to time to reflect changes in Ohio law or business practice; the effective date at the top of this page reflects the most recent revision.
